ANTI-CORRUPTION

DECISION NO. 055 CSPH/DG CREATING AN ANTI-CORRUPTION UNIT AT THE HYDROCARBONS PRICES STABILIZATION FUND (HPSF)

THE DIRECTOR GENERAL,

 

Mindful of the Constitution;

Mindful of Law No.2017/010 of 12 July 2017 to lay down the General Rules and Regulations governing Public Establishments;

Mindful of Decree No. 74/458 of 10 May 1974 creating the Hydrocarbons Prices Stabilisation Fund, amended by Decree 2019/032 of 24 January 2019 on

Mindful of Decree No.2006/088 of 11 March 2006 on the creation, organisation and functioning of the National Anti-Corruption Commission (CONAC);

Mindful of Decree No.2017/599 of 11 December 2017 appointing the Manager of the Hydrocarbons Prices Stabilisation Fund;

Mindful of Circular Letter No. 2001/005/CAB/PM of 18 July 2001 on the creation of internal anti-corruption units;

Considering service requirements,

 HEREBY DECIDES AS FOLLOWS:

Article 1: The Hydrocarbons Prices Stabilisation Fund (HPSF) hereby sets up an Anti-Corruption Unit, hereinafter referred to as the "Unit".

Article 2: Placed under the direct authority of the Director General, the Unit is responsible for:

• Designing and implementing an anti-corruption plan within the HPSF;
• Ensuring the effective implementation of anti-corruption measures prescribed to the HPSF as part of Government’s anti-corruption plan, by identifying the causes and manifestations of the phenomenon in advance;
• Promoting the integration of the National Anti-Corruption Strategy within the HPSF’s activities;
• Disseminating and promoting the texts and documents related to the National Anti-Corruption Strategy within the HPSF;
• Effectively relaying and implementing the National Anti-Corruption Commission (CONAC’s) anti-corruption initiatives;
• Carrying out all tasks relating to the prevention and punishment of corruption within the services and departments of the Establishment;
• Proposing measures to combat corruption.

 

Article 3: The Unit shall be composed as follows:

• A chairperson appointed from among the directors and those ranking as such at the HPSF;
• Five members:

• Four representatives of the HPSF;
• A representative of the civil society involved in the fight against corruption;

Article 4: The Chairperson may invite any individual with expertise in the items on the agenda to take part in the Unit's work in an advisory capacity.

Article 5: The appointment of the members of the Unit is confirmed by a decision of the Director General of the HPSF.

Article 6: (1) Members of the Unit have the right to access all services of the HPSF and are entitled to receive all documents and information necessary to carry out their duties.

(2) In the course of their work, members of the Unit may conduct field visits, interview individuals, carry out investigations, and verify information on-site or through documentation.

(3) Any refusal to provide the aforementioned documents and information constitutes a disciplinary offence punishable by law.

Article 7: The Chairperson and members of the Unit are bound by professional secrecy. As such, they are bound to keep secret all sources of denunciation and acts of corruption.

Article 8: (1) The Unit meets as often as necessary at the invitation of its Chairperson on an annual action programme approved in advance by the Director General.

(2) At the end of each of its meetings, missions or investigations, it shall draw up a report together with any proposals it deems necessary, which it shall send to the Director General of the HPSF.

Article 9: (1) The Unit shall submit copies of its mission and activity reports to the National Anti-Corruption Commission (CONAC).

(2) Moreover, it is obliged to support and assist CONAC in the framework of its missions at the HPSF.

Article 10: (1) The duties of the Chairperson, Member and Rapporteur of the Unit are free of charge. However, they, as well as any invited consultative members, are entitled to the necessary facilities for performing their duties, session allowances, and travel expenses in accordance with the current regulations.

(2) The operating expenses of the Unit are covered by the budget of the Hydrocarbons Prices Stabilisation Fund.

Article 11: This decision shall be registered and published wherever necessary.
